Representatives from Centex Homes requested, for a second time, the release of one of its performance bonds for work at the Windmere Grove residential development that was denied in December.
There has since been a township engineer’s report made, and an agreement from Centex Homes to post a nearly $33,”000 cash deposit for remaining work done on the site, Michael Vitiello, an attorney with the law firm Giordano, Halleran, & Ciesla, told the Township Committee during its March 11 meeting.
Because the engineer’s report was not issued until February 27, it missed the deadline to make it as an agenda item for the March 11 meeting, said Vitiello, who said Centex “would very much appreciate it” if the bond could be released by the end of March because the developer is wrapping up its budgeting process for the year. He requested that the committee possibly release the bonds during the next meeting on Wednesday, March 25.
The matter is listed as a possible action item on the agenda for the committee’s next meeting on Wednesday, March 25.
In December, the committee released the performance bonds and accepted maintenance bonds for two sections of work at the Estates at Plainsboro, as well as the streets associated with that area of development. However, the committee denied the release of the performance bond at Windmere Grover at Plainsboro (Wicoff Estates) — the development of 55 single-family homes off Wyndhurst Drive — after having time to review the concerns from the homeowners association about the work on site.
